Acceptance of Terms

By accessing or using XGames, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Anh Trinh.

Description of Service

XGames is a collection of 15 retro arcade, puzzle and card games:

All games work offline without an internet connection. A connection is only needed to make or restore a purchase. The App contains no advertising.

Eligibility

XGames is suitable for all ages. However:

• Users under 13 years old should use the App under parental supervision
• In-app purchases by minors should be made with a parent's or guardian's consent
• By using XGames, you represent that you meet these requirements

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use XGames on devices you own or control, solely for your personal, non-commercial use. On the App Store, this license is in addition to Apple's Licensed Application End User License Agreement.

4.1 You May:

• Install and play the games on your personal devices
• Play all games offline without an internet connection

4.2 You May NOT:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code
• Create derivative works or clone the App
• Use the App for any commercial purpose without written permission
• Remove or alter any proprietary notices or labels
• Tamper with the App to bypass the daily free-play limit, a purchase or a subscription
• Use automated tools or bots to play the games

Intellectual Property

All content, features, and functionality of XGames, including its pixel art, music, designs and code, are owned by Anh Trinh or their licensors and are protected by copyright, trademark and other intellectual property laws.

User Conduct

When using XGames, you agree to:

• Use the App only for lawful purposes
• Not attempt to cheat, hack, or exploit bugs
• Report any bugs or security vulnerabilities responsibly
• Respect the intellectual property of the App's creators

Free Plays, Purchases and Subscriptions

7.1 Daily Free Plays

• 5 free plays a day: XGames is free to download. Without a purchase you receive 5 play credits each day, which refill at midnight in your device's local time.
• One credit per game session: Starting a game uses one credit and opens that game for 30 minutes. Leaving and returning to the same game within that time does not use another credit.
• No carry-over: Unused credits do not roll over to the next day.

Either of the two options below removes the daily limit and unlocks unlimited play in every game.

• Type: One-time purchase. Not a subscription; it never renews.
• Price: $4.99 USD, or the equivalent shown in your local currency in the store
• Duration: Lifetime. Pay once, keep unlimited play with no expiry date.

🌟 XGames Monthly

• Type: Auto-renewable subscription
• Free Trial: 7 days free for new subscribers
• Price: $1.99 USD per month after the trial, or the equivalent shown in your local currency in the store
• Duration: 1 month, renewing automatically every month

7.2 Lifetime Purchase Terms

• One-Time Payment: Payment is charged once to your Apple ID or Google Play account when you confirm the purchase. There are no recurring charges.
• Permanent Access: Lifetime has no expiry date and includes future updates to the App at no extra cost.

7.3 Monthly Subscription Terms

• 7-Day Free Trial: New subscribers get a 7-day free trial. You are not charged during the trial, and if you cancel at least 24 hours before it ends you will not be charged at all. Each account can use the free trial once.
• Trial to Paid: Unless cancelled at least 24 hours before the trial ends, the subscription converts to a paid subscription at $1.99 USD per month.
• Automatic Renewal: The subscription renews automatically every month unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of each period.
• Payment: Payment is charged to your Apple ID or Google Play account at the end of the free trial, or at confirmation of purchase if no trial applies.
• Price Changes: We may change the subscription price. Changes are communicated in advance, as required by the App Store or Google Play, and apply only from your next renewal.
• Free Content: Without a purchase you can still play every game with your daily free plays.

7.4 Managing and Cancelling Your Subscription

For iOS (Apple App Store):

1. Open the Settings app on your iPhone or iPad
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "XGames"
5. Tap "Cancel Subscription"

For Android (Google Play):

1. Open the Google Play Store app
2. Tap your profile icon, then "Payments & subscriptions" → "Subscriptions"
3. Select "XGames"
4. Tap "Cancel subscription"

7.5 Restoring Your Purchase

Purchases and subscriptions are tied to your Apple ID or Google Play account, not to the device. On a new or reset device signed in to the same account, tap Restore Purchases in the App's Options screen or on the purchase screen. Restoring requires an internet connection.

7.6 Refunds

• Store policies apply: Purchases are processed by Apple or Google and are subject to their refund policies. We cannot issue refunds directly.
• Apple: Request a refund at reportaproblem.apple.com or contact Apple Support
• Google: Request a refund through the Google Play Store or contact Google Play Support

Availability and Updates

• Offline Access: All games work offline once the App is installed
• Local Data: High scores, stage progress and settings are stored only on your device. They are not backed up or synced, and are removed if you delete the App.
• Updates: We may release updates to improve games, fix bugs, or add or change games and features
• No Guarantees: We don't guarantee uninterrupted or error-free operation
• Modifications: We reserve the right to modify or discontinue the App with notice

Disclaimer of Warranties

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• We are not responsible for lost scores or progress, lost profits, or device damage
• Our total liability is limited to the amount you paid, if any, for purchases in the App

Termination

We may terminate or suspend your license to use XGames if you violate these Terms or engage in fraudulent or illegal activity.

You may stop using the App at any time by uninstalling it from your device.

Changes to Terms

We may update these Terms from time to time. When we do:

• We'll update the "Last updated" date
• Significant changes will be notified through the App
• Continued use after changes means you accept the new Terms

Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Vietnam.
