Terms of Service

Acceptance of Terms

By downloading, installing, accessing, or using XLoan: Debt Payoff Planner ("the App"), you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the App.

These Terms constitute a legally binding agreement between you and Anh Trinh, the developer of the App, publishing under the Davaco studio ("we", "us").

Description of Service

XLoan is a loan calculator and tracker. It calculates payments, interest and amortization schedules for home, car, personal, education and business loans and credit cards; compares loan offers and fixed against adjustable rates; tracks the loans you save and the payments you mark as paid; reminds you before payments are due; and plans how to pay your loans off sooner.

Not a Lender, Not Financial Advice

Free Plan and Premium

• Premium is a one-time, non-consumable in-app purchase. It is not a subscription: there is no trial, no renewal and nothing to cancel
• The price is shown in the App before you buy, in your local currency, and charged to your Apple Account when you confirm the purchase
• A launch discount may be shown against a higher original price; the price you pay is the one Apple shows when you confirm
• Premium unlocks features on the devices signed in to the same Apple Account, for as long as the App is available

Refunds and Restoring Purchases

Purchases are processed by Apple, and refunds are handled by Apple under its policies. You can request a refund at reportaproblem.apple.com. We are unable to issue refunds directly.

If you reinstall the App or use a new device signed in to the same Apple Account, tap Restore on the Premium screen to restore your purchase at no charge.

Your Data and iCloud Sync

The loans and documents you enter are yours. We claim no rights over them and do not access them. They are stored on your device and, if you turn on iCloud sync, in your own iCloud account, which is subject to Apple's terms, including its storage limits.

You are responsible for keeping your device and Apple Account secure, and for keeping a backup. Because we never hold a copy of your data, we cannot recover it if your device is lost while sync was off, or if you delete your iCloud data or forget your backup password.

Reminders

Payment reminders and check-ins are a convenience, scheduled on your device from the due dates you entered. They depend on your notification settings and on your device being on, and may not fire if those change. You remain responsible for making your payments on time; we are not liable for missed or late payments.

Acceptable Use

You agree to use the App only for lawful, personal purposes. You must not:

• Use the App for any illegal or unauthorized purpose
• Present the App's results as an offer of credit or as advice to others
• Reverse engineer, decompile, modify or resell the App or its content
• Attempt to bypass purchases or unlock paid features without paying
• Interfere with the App's operation or security

Intellectual Property

The App, including its design, illustrations, icons, text and code, is owned by Anh Trinh and protected by intellectual property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal, non-commercial purposes.

Disclaimers and Limitation of Liability

The App is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not guarantee that the App's calculations will match your lender's, that the App will be uninterrupted or error-free, or that iCloud sync or exchange rates will always be available, as those services are operated by others.

To the maximum extent permitted by law, Anh Trinh shall not be liable for any indirect, incidental, special or consequential damages, for financial decisions made using the App, or for loss of data, arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

Apple App Store Terms

Your use of the App is also governed by Apple's Licensed Application End User License Agreement (Standard EULA). In addition, you and we acknowledge that:

• These Terms are between you and us only, not with Apple, and we, not Apple, are solely responsible for the App and its content
• Apple has no obligation to provide any maintenance or support for the App
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims
• You represent that you are not located in a country subject to a U.S. Government embargo, and are not on any U.S. Government list of prohibited or restricted parties
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

Termination

These Terms remain in effect until terminated. We may terminate your license to use the App if you materially breach these Terms. You may stop using the App at any time by uninstalling it. Your data on your device and in your own iCloud remains yours after termination.

Changes to Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, let you know in the App. Continued use after changes take effect constitutes acceptance. Changes never take away a purchase you have already made.

Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict of law rules, except where the consumer protection laws of your country of residence give you the right to rely on them.
