Acceptance of Terms

By downloading or using XHealth: Family Health Records ("XHealth", "the App"), published by Anh Trinh under the Davaco studio ("we", "us"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the App.

Description of Service

XHealth is a personal health record book for you and your family. It lets you keep visits, papers, lab results, prescriptions and medicines; reads the text of papers you photograph on your device to help you fill them in; schedules medicine and follow-up reminders; and creates a PDF of your records and an emergency card you can share. The App works without an account and stores your records on your device.

Free Plan and XHealth Family

XHealth is free to download and use. XHealth Family is an optional subscription that unlocks the App's paid features for your whole family book.

The features in each plan are also shown on the XHealth Family screen in the App before you subscribe. We may add features to either plan over time.

Subscription Plans, Trials and Cancellation

5.1 Subscription Plans

XHealth Family is offered as two auto-renewable subscriptions in one subscription group. You can have one of them at a time:

⭐ XHealth Family Annual

• Type: Auto-renewable subscription
• Length: 1 year, renewing automatically every year
• Free trial: 3 days for new subscribers
• Price: $19.99 USD per year after the trial (₫599,000 in Vietnam), or the equivalent shown in your local currency in the App Store

XHealth Family Monthly

• Type: Auto-renewable subscription
• Length: 1 month, renewing automatically every month
• Free trial: None
• Price: $2.99 USD per month (₫99,000 in Vietnam), or the equivalent shown in your local currency in the App Store

Prices may vary by country and may include local taxes. The price, length and any trial that apply to you are always shown in the App and in Apple's purchase sheet before you confirm.

5.2 Subscription Terms

• Payment: Payment is charged to your Apple Account when you confirm the purchase, or at the end of the free trial if one applies.
• Free Trial: You are not charged during the 3-day trial of the Annual plan, and if you cancel at least 24 hours before it ends you will not be charged at all. Each Apple Account can use the introductory trial once. Any unused part of a trial ends when you buy a subscription.
• Trial to Paid: Unless cancelled at least 24 hours before the trial ends, the trial converts to a paid Annual subscription at the price shown when you started it.
• Automatic Renewal: Your subscription renews automatically for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Switching Plans: You can switch between the Monthly and Annual plans in your subscription settings. Apple applies the change immediately or at your next renewal date, according to its rules.
• Price Changes: We may change subscription prices. Apple notifies you in advance and, where required, asks for your consent; a new price applies only from your next renewal.
• Without a Subscription: If your subscription ends, your records stay on your device and you keep using the free plan. Nothing you added is deleted.

5.3 Managing and Cancelling Your Subscription

On iPhone or iPad:

1. Open the Settings app
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "XHealth Family"
5. Tap "Cancel Subscription", or choose another plan

You can also manage your subscription at apps.apple.com/account/subscriptions.

Refunds and Restoring Purchases

Purchases are processed by Apple, and refunds are handled by Apple under its policies. You can request a refund at reportaproblem.apple.com. We are unable to issue refunds directly.

If you reinstall the App or use a new device signed in to the same Apple Account, tap Restore purchases ("Khôi phục mua hàng") on the XHealth Family screen to restore your subscription at no charge.

Your Data

The records, photos and notes you add are yours. We claim no rights over them and do not access them. They are stored only on your device.

You are responsible for keeping your device secure and for keeping your own copy of important papers. Because we never hold a copy of your data, we cannot recover it if your device is lost or reset, or if you delete it. Until iCloud backup is released, exporting a PDF from time to time is a good way to keep a copy.

Reminders

Medicine and follow-up reminders are a convenience, scheduled on your device from the schedule and dates you entered or confirmed. They depend on your notification settings, Focus modes and your device being on, and may not fire if those change. You remain responsible for taking your medicines as prescribed and for attending your appointments; we are not liable for missed or late doses or visits.

Records of Family Members

You may keep records for family members whose health you look after, such as your children or parents. By adding someone else's information, you confirm that you are allowed to keep it, for example as their parent or carer or with their agreement, and that you will keep it private.

Acceptable Use

You agree to use the App only for lawful, personal purposes. You must not:

• Use the App for any illegal or unauthorized purpose, or to store information about people without the right to do so
• Use the App to provide medical services to others or present its content as medical advice
• Reverse engineer, decompile, modify or resell the App or its content
• Attempt to bypass purchases or unlock paid features without paying
• Interfere with the App's operation or security

Intellectual Property

The App, including its design, illustrations, icons, text, reading model and code, is owned by Anh Trinh or its licensors and protected by intellectual property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal, non-commercial purposes.

Disclaimers and Limitation of Liability

The App is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not guarantee that text read from your papers will be complete or correct, that reminders will always be delivered, or that the App will be uninterrupted or error-free.

To the maximum extent permitted by law, Anh Trinh shall not be liable for any indirect, incidental, special or consequential damages, for health decisions made using the App, or for loss of data, arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

Apple App Store Terms

Your use of the App is also governed by Apple's Licensed Application End User License Agreement (Standard EULA). In addition, you and we acknowledge that:

• These Terms are between you and us only, not with Apple, and we, not Apple, are solely responsible for the App and its content
• Apple has no obligation to provide any maintenance or support for the App
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims
• You represent that you are not located in a country subject to a U.S. Government embargo, and are not on any U.S. Government list of prohibited or restricted parties
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

Termination

These Terms remain in effect until terminated. We may terminate your license to use the App if you materially breach these Terms. You may stop using the App at any time by uninstalling it; uninstalling does not cancel a subscription, which you manage in your Apple Account. Your data on your device remains yours after termination.

Changes to Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, let you know in the App. Continued use after changes take effect constitutes acceptance. Changes never take away a subscription period you have already paid for.

Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict of law rules, except where the consumer protection laws of your country of residence give you the right to rely on them.
